TERMS AND CONDITIONS OF ENTRY
These Terms and Conditions of Entry govern the contractual relationship between the Participant and Red On Group Limited trading as Red On Sports in relation to explorr Festival and all associated event products.
1. ABOUT THESE TERMS
1.1
These Terms and Conditions of Entry (“Terms”) govern the contractual relationship between Red On Group Limited trading as Red On Sports (“Red On Sports”, “we”, “us”, “our”) and the person registering for, purchasing a ticket for, attending, or participating in explorr Festival (“you”, “your”, the “Participant”).
1.2
By registering for, purchasing a ticket for, attending, or participating in any part of explorr Festival, you agree to be bound by these Terms.
1.3
These Terms apply to all aspects of explorr Festival, including but not limited to:
(a) the explorr Gravel Stage Race;
(b) explorr Run events, including 5km, 10km, Half Marathon and Marathon;
(c) the Charity Night Hike;
(d) Kids Running Race;
(e) Kids Cycling Race;
(f) Festival Village access and Festival Tickets;
(g) athlete talks, interviews, screenings, expo activity, music and community programming; and
(h) all Optional Extras.
1.4
If you do not agree to these Terms, you must not register for, purchase a ticket for, attend, or participate in the Event.
1.5
We reserve the right to amend, update or vary these Terms at any time. Any amended version shall take effect upon publication on the official Event website unless stated otherwise.
1.6
It is your responsibility to check the latest version of these Terms before attending or participating in the Event.
2. THE ORGANISER
2.1
The Event is organised and delivered by Red On Group Limited trading as Red On Sports, a company registered in England and Wales under company number 13552080, with registered office at 33a Cherry Orton Road, Peterborough, PE2 5EQ, United Kingdom.
2.2
All references in these Terms to Red On Sports include our employees, officers, contractors, subcontractors, suppliers, event officials, volunteers, agents and authorised delivery partners, where applicable.
3. DEFINITIONS
In these Terms, the following definitions apply:
3.1
“Brand” means all logos, names, slogans, designs, trade marks, artwork, imagery, route maps, promotional materials and associated intellectual property belonging to or licensed to Red On Sports in connection with the Event.
3.2
“Event” means explorr Festival, a multi-day outdoor endurance festival taking place in Banchory, Aberdeenshire, Scotland, including all races, activities, tickets, access products, programming and Optional Extras made available by Red On Sports.
3.3
“Event Guide” means any official participant guide, briefing note, race guide, event information pack, safety instructions, route notes or similar documentation published by Red On Sports before the Event.
3.4
“Event Official” means any person authorised by Red On Sports to act in an official capacity at the Event, including marshals, referees, race directors, medics, volunteers, staff, security personnel and contractors.
3.5
“Event Registration” means the official registration process or area where Participants confirm attendance and collect bibs, timing chips, race numbers, accreditation, wristbands or other Event materials.
3.6
“Event Village” means the central event hub at explorr Festival, including registration, information desk, expo, food and drink areas, music and programming spaces, public gathering spaces and related facilities.
3.7
“Festival Ticket” means a free or paid ticket granting access to specified parts of the Event Village and related festival activities, subject to these Terms.
3.8
“Info Desk” means the official event information point where Participants and attendees may seek assistance regarding registration, event logistics, lost property and general enquiries.
3.9
“Open Road Sections” means any part of an Event route where normal traffic laws, land access rules, shared-use path rules or the Highway Code continue to apply.
3.10
“Optional Extras” means any add-ons purchased in addition to a race entry or Festival Ticket, including but not limited to camping, parking, merchandise, hospitality, photo packages and similar products.
3.11
“Participant” means any person who has registered for, purchased a ticket for, attends or takes part in any Event activity.
3.12
“Race Director” means the person appointed by Red On Sports to oversee a race or competitive discipline within the Event.
3.13
“Registration Application” means any entry form, ticket booking, online registration, purchase or official application process used to obtain access to or participation in the Event.
3.14
“Specified Location” means any location on an Event route which a Participant must reach by a stated time in order to continue.
3.15
“Specified Time” means any cut-off, deadline or time limit published by Red On Sports before or during the Event.
3.16
“Website” means the official explorr website (explorr.co.uk) and any official registration or ticketing platform used by Red On Sports for the Event.
4. FORMATION OF CONTRACT
4.1
A contract between you and Red On Sports is formed when:
(a) you submit a Registration Application;
(b) you accept these Terms; and
(c) payment is successfully received, where payment is required.
4.2
Where a Festival Ticket or Event product is free of charge, a contract is formed when your registration or booking is accepted by Red On Sports.
4.3
You warrant that all information you provide in connection with your registration, booking or attendance is true, accurate and complete.
4.4
If you are registering on behalf of another person, you confirm that you are authorised to do so and that you have authority to bind that person to these Terms.
5. SCOPE OF THE EVENT
5.1
The Event is a multi-sport, multi-activity festival. Different Event products may have different rules, participation criteria, age restrictions, safety requirements, routes, capacities and operating conditions.
5.2
Full details of Event products will be published on the Website and/or in the Event Guide.
5.3
Red On Sports reserves the right to alter, amend, shorten, postpone, cancel, suspend, relocate or otherwise change:
(a) Event dates;
(b) Event format;
(c) routes and course layouts;
(d) Event capacities;
(e) start times;
(f) opening times;
(g) programming;
(h) venues or locations; and
(i) operational arrangements,
at any time and without prior notice where reasonably necessary.
5.4
Changes may be made for reasons including, but not limited to, weather, safety, public authority advice, land access issues, infrastructure issues, environmental concerns, force majeure, participant welfare or operational requirements.
5.5
Participation in the Event is at the sole discretion of Red On Sports. Registration or ticket purchase does not guarantee completion, podium eligibility, access to all areas or participation in all advertised activities.
6. ELIGIBILITY AND AGE REQUIREMENTS
6.1
You may only register for or participate in an Event product if you meet the eligibility criteria published for that product.
6.2
Minimum age limits, supervision requirements and category rules vary across Event products and will be published on the Website and/or in the Event Guide.
6.3
Where a Participant is under the age of 18:
(a) the registration or booking must be completed by a parent or legal guardian;
(b) the parent or legal guardian accepts these Terms on behalf of the minor; and
(c) the parent or legal guardian accepts full responsibility for the minor’s participation, attendance and compliance with these Terms.
6.4
Children attending the Event as spectators or visitors remain under the full responsibility of their parent or legal guardian at all times unless participating in a supervised official Event activity.
6.5
Red On Sports reserves the right to refuse entry or participation where age or eligibility requirements are not met.
7. ENTRY, REGISTRATION AND IDENTIFICATION
7.1
Participants must complete Event Registration in accordance with the instructions published for the relevant Event product.
7.2
You may be required to present photographic identification, booking confirmation, proof of age, parental consent documentation, or other reasonably requested documentation at Event Registration.
7.3
Failure to provide required documents may result in refusal of participation or attendance without refund.
7.4
Where bib numbers, timing chips, wristbands, accreditation, parking permits or other Event materials are issued, these remain the property of Red On Sports unless expressly stated otherwise.
7.5
Participants must wear, display or attach all Event-issued identifiers in the manner instructed by Red On Sports.
7.6
No Participant may unofficially swap, alter, duplicate, sell, transfer, share or tamper with any bib, timing chip, race number, accreditation or ticket.
8. FESTIVAL TICKETS AND EVENT ACCESS
8.1
A Festival Ticket grants access only to the parts of the Event and festival programming described at the time of booking.
8.2
Some Event activities may require:
(a) a separate booking;
(b) a separate paid entry;
(c) proof of eligibility;
(d) compliance with additional event-specific rules; or
(e) may be subject to capacity limits.
8.3
A free Festival Ticket does not guarantee access to any activity with restricted capacity or separate registration requirements.
8.4
All Festival Ticket holders must comply with site rules, signage and instructions from Event Officials.
8.5
Red On Sports reserves the right to refuse admission to or remove any person from the Event Village or other Event areas for safety, security, legal or behavioural reasons.
9. EVENT-SPECIFIC RULES
9.1
Additional Event-specific rules may apply to particular disciplines or activities, including but not limited to:
(a) helmet requirements for cycling events;
(b) bib display requirements for running events;
(c) cut-off times;
(d) route restrictions;
(e) classification rules;
(f) age group rules;
(g) mandatory kit requirements; and
(h) no-outside-assistance rules.
9.2
Event-specific rules form part of these Terms and are incorporated into this agreement by reference.
9.3
In the event of conflict between these Terms and Event-specific rules, these Terms shall prevail except where the Event-specific rules expressly state otherwise.
10. PARTICIPANT RESPONSIBILITIES
10.1
By attending or participating in the Event, you confirm and agree that:
(a) you participate entirely at your own risk;
(b) you are fit, healthy and sufficiently prepared for the activity you have entered;
(c) you have sought medical advice if required;
(d) you will follow all instructions given by Event Officials;
(e) you will behave responsibly and respectfully;
(f) you will not act in a way which endangers yourself or others;
(g) you will not damage the environment, Event venue, route or infrastructure; and
(h) you will comply with all applicable laws and regulations.
10.2
You are responsible for your own judgement, actions and safety at all times, even where information, route signage, marshal guidance or Event assistance is provided.
10.3
You must not participate in any race, ride, hike or organised physical activity while under the influence of alcohol, illegal drugs or any substance that may impair your ability to participate safely.
10.4
You must not behave in a threatening, abusive, discriminatory, harassing, dangerous or disorderly manner toward any Participant, Event Official, volunteer, contractor, landowner, resident or spectator.
10.5
You must immediately comply with any instruction from Red On Sports or an Event Official to stop, withdraw, reroute, slow down, leave the course, leave the Event site or take any other action.
11. EQUIPMENT, KIT AND CLOTHING
11.1
You are solely responsible for ensuring that all equipment, clothing and footwear used by you at the Event is suitable, safe, serviceable and compliant with the rules of the relevant Event product.
11.2
This includes, where relevant:
(a) a roadworthy and suitable bicycle;
(b) an approved cycling helmet;
(c) suitable running footwear and clothing;
(d) weather-appropriate clothing;
(e) any mandatory torch or headlamp;
(f) any mandatory hydration, nutrition or safety equipment; and
(g) any mandatory medical or identification information on bibs or race numbers.
11.3
Red On Sports reserves the right to refuse participation where equipment, kit or clothing is unsafe, non-compliant or unsuitable.
12. HEALTH, MEDICAL AND EMERGENCY PROVISIONS
12.1
Participation in endurance sports and outdoor activities carries inherent risks, including serious injury or death.
12.2
You acknowledge and accept those risks.
12.3
Red On Sports will provide such medical and emergency support as it considers reasonable and appropriate having regard to the nature of the Event and relevant risk assessments.
12.4
Red On Sports does not guarantee specific response times, response locations or outcomes in the event of an incident.
12.5
You authorise Red On Sports and Event medical personnel to administer or procure emergency first aid and medical treatment in the event that you require such assistance during the Event.
12.6
Any costs of onward treatment, transport, personal medication, repatriation or similar matters remain your responsibility unless otherwise required by law.
13. ROUTES, OPEN ROADS AND CUT-OFFS
13.1
Some Event routes may include Open Road Sections, shared-use routes, forest tracks, public spaces, private land, shared access routes, or areas where other members of the public may be present.
13.2
You must:
(a) comply with the Highway Code and all applicable laws;
(b) exercise due care and attention at all times;
(c) respect other road users and land users;
(d) follow Event signage and official instructions; and
(e) adapt your speed and conduct to conditions.
13.3
Red On Sports may impose cut-offs, route closures, checkpoint deadlines and Specified Times.
13.4
If you fail to meet a Specified Time or reach a Specified Location by the relevant deadline, you may be:
(a) withdrawn from the Event;
(b) redirected;
(c) classified differently; or
(d) prevented from continuing.
13.5
If you withdraw or are withdrawn from an Event route, you must notify an Event Official or the Info Desk as soon as possible.
14. ENVIRONMENTAL RESPONSIBILITY
14.1
explorr takes place within sensitive outdoor environments and all Participants and attendees must respect the land, wildlife, vegetation, local communities and surrounding environment.
14.2
Littering, fly-tipping, damaging property, disturbing livestock or wildlife, or otherwise harming the environment is strictly prohibited.
14.3
Any person found breaching environmental standards may be disqualified, removed from the Event, denied future entry, and may be reported to the relevant authorities where appropriate.
15. SECURITY, PROPERTY AND BAG DROP
15.1
You remain responsible for your own personal property at all times.
15.2
Red On Sports accepts no liability for loss, theft or damage to personal property unless such loss, theft or damage is caused by our negligence and cannot lawfully be excluded.
15.3
Where a bag drop or similar facility is provided, it is offered for convenience only unless expressly stated otherwise.
15.4
Items left in bag drop are left at your own risk, subject only to liability that cannot lawfully be excluded.
15.5
Participants should not leave valuables in bag drop or unattended anywhere on the Event site.
16. Transfers, Refunds and Deferrals
16.1 Non-Refundable Entries
16.1.1
All Event entries, Festival Tickets and Optional Extras purchased by You are strictly non-refundable, except where Red On Sports rejects a Registration Application in accordance with these Terms or where required by applicable law.
16.1.2
Entry fees do not include reimbursement for any travel, accommodation or other costs incurred by Participants in connection with the Event.
16.2 Entry Transfer to Another Participant
16.2.1
You may transfer Your Event entry (including any Optional Extras attached to that entry) to another Participant by following the official transfer process provided through the Event registration platform or Website.
16.2.2
The deadline for entry transfers is July 27th, 2026 at 23:59 GMT. No transfer requests will be accepted after this date.
16.2.3
It is Your responsibility to ensure that the new Participant meets all eligibility requirements for the relevant Event discipline and agrees to these Terms and Conditions.
16.2.4
Unofficial resale, exchange or transfer of entries, bib numbers, timing chips, Festival Tickets or Event credentials is strictly prohibited and may result in cancellation of the entry without refund.
16.3 Entry Deferral to the Following Year
16.3.1
You may defer Your Event entry (including any Optional Extras purchased with that entry) to the following year’s explorr Festival if Red On Sports is able to find a replacement for Your entry.
16.3.2
Deferral requests are subject to the following deadlines and administrative fees:
• Until May 31st, 2026 at 23:59 GMT: £10 administration fee
• Between June 1st, 2026 at 00:00 GMT and July 1st, 2026 at 23:59 GMT: £15 administration fee
• Between July 2nd, 2026 at 00:00 GMT and July 27th, 2026 at 23:59 GMT: £20 administration fee
16.3.3
No deferral requests will be accepted after July 27th, 2026 at 23:59 GMT.
16.3.4
All deferral requests must be submitted via email to info@explorr.cc before the applicable deadline.
16.3.5
Deferrals are valid for one edition only and may not be deferred again.
16.4 Duplicate Entries
16.4.1
If You mistakenly purchase more than one entry for the same Event, any surplus entry will be refunded, provided that You notify Red On Sports via email at info@explorr.cc before July 27th, 2026 at 23:59 GMT.
16.4.2
Refunds for duplicate entries may exclude any payment processing fees incurred by Red On Sports.
16.5 General Conditions
16.5.1
All administrative fees for transfers or deferrals must be paid in full before the request is processed.
16.5.2
Once an entry has been successfully transferred or deferred, the original Participant forfeits all rights to attend or participate under that entry.
16.5.3
Red On Sports reserves the right to refuse any transfer or deferral request where the eligibility requirements, deadlines or administrative procedures have not been satisfied.
16.5.4
Free Festival Tickets may be cancelled or reissued by Red On Sports at any time and are not eligible for formal deferral.
17. OPTIONAL EXTRAS
17.1
Optional Extras may include, without limitation, camping, parking, merchandise, photo packages, hospitality and similar add-on products.
17.2
Optional Extras are subject to availability and may have separate collection, redemption, use and expiry conditions.
17.3
Unless expressly stated otherwise:
(a) Optional Extras are non-refundable;
(b) Optional Extras are non-transferable except through an official process where offered; and
(c) Optional Extras may only be collected during the Event weekend.
17.4
Red On Sports reserves the right to substitute, withdraw, relocate or amend Optional Extras where reasonably necessary.
18. MEDIA, FILMING, PHOTOGRAPHY AND IMAGE RIGHTS
18.1
The Event is a public event and photography, video recording, drone filming and audio recording may take place throughout the Event site and routes.
18.2
By attending or participating in the Event, you irrevocably grant Red On Sports, its affiliates, sponsors, commercial partners, media partners and authorised third parties a worldwide, perpetual, royalty-free licence to:
(a) photograph, film and record you;
(b) use your name, image, likeness, voice and performance; and
(c) reproduce, edit, adapt, publish, distribute, broadcast, display and otherwise exploit such material,
for promotional, editorial, archival, commercial and marketing purposes in any media now known or later developed.
18.3
You waive any right to inspect or approve the finished materials and waive any right to compensation in connection with such use.
18.4
All Event photography, recordings and footage captured by or on behalf of Red On Sports remain our property or the property of the authorised creator.
18.5
Any photography, filming or recording you make at the Event is for personal, non-commercial use only unless Red On Sports gives prior written consent for commercial use.
18.6
Commercial exploitation of Event imagery, footage or recordings by any third party without prior written permission is prohibited.
19. INTELLECTUAL PROPERTY
19.1
All rights, title and interest in and to the Brand and all Event-related intellectual property remain vested in Red On Sports and/or its licensors.
19.2
Nothing in these Terms grants you any ownership or licence rights in the Brand other than the limited right to attend or participate in the Event in accordance with these Terms.
19.3
You must not use, reproduce, publish, copy, distribute or exploit any Event intellectual property for commercial purposes without prior written consent.
20. DATA PROTECTION AND PRIVACY
20.1
Red On Sports will process personal data in accordance with applicable data protection law and the Red On Sports privacy policy.
20.2
By registering for, attending or participating in the Event, you acknowledge that your personal data may be collected, stored, used and shared for purposes including:
(a) Event administration;
(b) results processing;
(c) medical and safety management;
(d) customer service;
(e) fraud prevention;
(f) legal compliance;
(g) marketing where consent or another lawful basis applies; and
(h) charity-linked administration where relevant.
20.3
Where you enter a charity-linked Event product or use a charity-specific entry mechanism, certain personal data may be shared with the relevant charity to the extent necessary to administer that product or where you have consented.
20.4
You are responsible for ensuring that the personal data you provide is accurate and up to date.
21. INSURANCE
21.1
You are responsible for arranging and maintaining such insurance as you consider appropriate in relation to your participation or attendance, including personal accident, travel, cancellation, medical and equipment insurance.
21.2
Participants in cycling events are strongly encouraged, and may in some cases be required, to hold suitable third-party liability insurance where stated in the Event Guide or event-specific rules.
21.3
Red On Sports does not provide personal accident, medical, travel, cancellation or equipment insurance for Participants unless expressly stated otherwise.
22. LIMITATION OF LIABILITY
22.1
Nothing in these Terms shall exclude or limit liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any other liability which cannot lawfully be excluded or limited.
22.2
Subject to clause 22.1, Red On Sports shall not be liable for:
(a) loss of profit;
(b) loss of revenue;
(c) loss of opportunity;
(d) loss of enjoyment;
(e) loss of goodwill;
(f) indirect loss;
(g) consequential loss; or
(h) loss arising from cancellation, postponement, route change, reduced access, shortened format or force majeure circumstances.
22.3
Subject to clause 22.1, Red On Sports shall not be liable for any loss, injury, damage, cost or expense suffered by you arising from:
(a) your participation in or attendance at the Event;
(b) your failure to follow instructions;
(c) your own negligence or actions;
(d) the actions of other participants, spectators or third parties;
(e) route conditions, weather, terrain or natural hazards; or
(f) loss of or damage to personal property.
22.4
To the fullest extent permitted by law, you participate in and attend the Event at your own risk.
23. FORCE MAJEURE
23.1
Red On Sports shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control.
23.2
Force majeure events include, without limitation:
(a) severe weather;
(b) flood, fire or natural disaster;
(c) epidemic or pandemic;
(d) war, terrorism or civil unrest;
(e) industrial action;
(f) power or communications failure;
(g) land access issues;
(h) public authority restrictions;
(i) safety incidents; and
(j) any other event beyond our reasonable control.
23.3
If the Event is cancelled, postponed, relocated, suspended, shortened or materially changed because of force majeure, Red On Sports shall not be responsible for any travel, accommodation, subsistence or other costs incurred by you.
23.4
In force majeure circumstances, entries, tickets and Optional Extras are non-refundable unless Red On Sports decides otherwise at its sole discretion.
23.5
Red On Sports may, at its sole discretion, offer a deferral, transfer, partial refund, credit or alternative arrangement in such circumstances, but is under no obligation to do so.
24. BREACH, DISQUALIFICATION AND REMOVAL
24.1
Red On Sports may disqualify, withdraw, remove or refuse access to any Participant or attendee who breaches these Terms, any Event-specific rules, the Event Guide, or any instruction given by an Event Official.
24.2
Grounds for disqualification or removal include, but are not limited to:
(a) unsafe conduct;
(b) abusive or discriminatory behaviour;
(c) refusal to follow instructions;
(d) fraudulent registration;
(e) tampering with timing devices or bibs;
(f) unofficial transfer of entries or tickets;
(g) littering or environmental damage;
(h) participating while impaired by alcohol or drugs;
(i) route cutting, cheating or unsporting behaviour;
(j) breach of road rules, access rules or land use rules; and
(k) any conduct likely to bring the Event into disrepute.
24.3
Where action is taken under this clause, no refund shall be payable.
24.4
Red On Sports may prohibit any person removed or disqualified under this clause from entering future Red On Sports events.
25. PAYMENT PROCESSING AND ONLINE SYSTEMS
25.1
Online payments and registrations may be processed through third-party providers such as Eventrac, Stripe or other authorised providers.
25.2
Use of those systems may be subject to the terms and privacy policies of the relevant third-party provider.
25.3
Red On Sports is not liable for technical failures, outages or payment errors caused by third-party systems outside our reasonable control.
26. COOKIES AND WEBSITE USE
26.1
The Website may use cookies and similar technologies to improve functionality, user experience and registration processes.
26.2
By using the Website, you agree to the use of cookies in accordance with the applicable cookies policy.
27. THIRD PARTY RIGHTS
27.1
These Terms are intended solely for the benefit of you and Red On Sports.
27.2
No third party shall have any right to enforce any term of these Terms under the Contracts (Rights of Third Parties) Act 1999, save where expressly stated otherwise.
28. SEVERABILITY
28.1
If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
29. ENTIRE AGREEMENT
29.1
These Terms, together with any Event-specific rules, the Event Guide, the privacy policy and any official Event documentation expressly incorporated by reference, constitute the entire agreement between you and Red On Sports in relation to the Event.
29.2
You acknowledge that you have not relied on any statement, representation or promise not expressly set out in these Terms or the documents incorporated by reference.
30. GOVERNING LAW AND JURISDICTION
30.1
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, unless Red On Sports elects to issue an Event-specific version governed by Scots law.
30.2
The courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
